What Constitutes Cocaine Possession?

According to the DEA, cocaine is a Schedule II drug, meaning that it’s considered to be dangerous and has a high risk of abuse.

Schedule II drugs are also identified as having a high potential for severe physical or psychological dependence.

Other Schedule II drugs include methamphetamine, methadone, Adderall, and Ritalin.

Cocaine charges

Cocaine comes in two forms:

  • Hydrochloride salt powder
  • Crack cocaine

Possession of cocaine is determined by whether or not you have control over the drug.

This means that you can be charged with possession even when the drug is not physically on your person.

For example, if it’s found in your home, car, or office, you potentially could be charged with possession.

The punishment and fines for possession are determined by the severity and circumstances of your case.

Penalties for a conviction of cocaine possession include:

  • Possession of fewer than 50 grams: Imprisonment up to four years and/or a $25,000 fine
  • Possession of 50 to 449 grams: Imprisonment up to 20 years and/or $250,000 fine
  • Possession of 450 to 999 grams: Imprisonment up to 30 years and/or $500,000 fine
  • Possession of 1,000 grams or more: Life imprisonment and/or $1,000,000 fine

Other cocaine charges can include manufacturing, delivery, and trafficking.

Mr. Morris and his associates legal knowledge is unsurpassed bar none. Although my case was unique, having been on the lam for sixteen years, Mr. Morris was able to prove that the lack of evidence was detrimental to the prosecution and all charges were dismissed. Mr. Morris happened to be the second lawyer that I contacted. The first lawyer said he would take my case for a $10K retainer fee and that I had a long road ahead of me. The next day, I contacted Mr. Morris and knew from our first conversation that I was in good hands with his representation. Stop shopping around and hire Barton Morris today!
